Motoring offence

Motoring offences: Fixed fee

At Andreea Anca Moscovici Avocat Roman UK we provide legal services for motoring offences under Part I Road Traffic Act 1988 and s 89 Road Traffic Regulation Act 1984.

The main offences that we can represent clients are drink driving, dangerous driving, speeding and similar road traffic offences.

Unless stated as a specific exclusion, the price displayed normally include:

  • Reviewing available evidence
  • Providing legal advice in relation to plea and likely sentence
  • Where we cannot anticipate the likely sentence, advice on the options available to the court in relation to sentencing

Detailed initial consultation

We can provide an hour of initial advice if you require guidance without our representation in court.

Our fixed fee for consultation is £350 and can be provided either in writing, by telephone or Skype or to our office in London or Manchester.

Letter of representations

  • We can assist with writing a letter of representations outlining the circumstances of your offence to ensure the court has all the facts to reach a fully informed decision in your case for an agreed fixed fee of £900
  • We can also write a letter of representations to the police or a prosecuting authority to try and dissuade them from either issuing or proceeding with your case for an agreed fixed fee of £850

Magistrate Court First appearance – Guilty plea/ Not guilty plea adjourned for trial- fixed fee- £2000

Fee includes:

  • Reviewing and considering available evidence
  • Taking full instructions
  • Providing advice on likely sentence
  • Arranging for and instructing a barrister for the hearing
  • Drafting and sending brief to counsel

The fee does not include:

  • The costs of barrister’s attendance and representation at a single hearing at a Magistrates’ Court
  • Instruction of any expert witnesses
  • Taking statements from any witnesses
  • Advice and assistance in relation to a special reason hearing
  • Advice and assistance in relation to any appeal
  • Any additional hearings, if matter is adjourned for sentence or due to other reasons i.e. case being adjourned, your or interpreter’s failure to appear in court, there will be an additional charge of £895

The above fee is based on the presumption that you have entered a guilty plea and have a fixed date for your hearing and includes;

  • Contacting your solicitor to provide instructions on what happened.
  • The solicitor will consider initial disclosure, and any other available evidence and provide advice
  • We will arrange to take any witness statements if necessary (this will cost additional £895 and include up to 3 hours and a half for preparation)
  • The solicitor will explain the court procedure to you, so you know what to expect on the day of your hearing, and the sentencing options available to the Court
  • We will conduct any further required preparatory work, obtain further instruction from you if necessary and answer any follow up queries you may have
  • We cannot provide a timescale of when your hearing will take place, as this depends on the court listing for that day
  • We will attend court on the day and meet with you before going before the court. We anticipate being at court for a half a day (if more time is required there may be additional cost calculated on an hourly rate of £350/h)
  • We will discuss the outcome with you. If advice is required on appeal, this will be carried on for additional cost.

Magistrates Court – trial – Fixed fee of £2995-£7995, depending on the complexity of the case

 

Fee includes:

  • Reviewing and considering evidence
  • Taking full instruction
  • Providing advice on likely sentence
  • Arranging for and instructing a barrister for the hearing
  • Drafting and sending brief to counsel
  • Drafting statements of case in support of unguilty plea

The fee does not include:

  • Attendance and representation at a single hearing at the Magistrate Court
  • Instruction of any expert witnesses
  • Taking statements from witnesses
  • Advice and assistance in relation to a special reason hearing
  • Advice and assistance in relation to any appeal
  • Additional hearings, if the matter is more complex and is listed for Case Management or Pre-Trial Review Hearing, there will be an additional charge of £895 per hearing plus cost of instructing barrister

for second or subsequent trial date, if the matter is listed for more than one day of the trial there will be an additional charge to be confirmed

We add VAT to our charges.
